Terms and Conditions of Use for Captions for Instagram (Captagram)

The Captagram mobile application (the “App”) is provided by Aureolls. By using the App, you agree to be bound by these Terms and Conditions of Use.

1. License: Aureolls grants you a limited, non-exclusive, non-transferable license to download and use the App on a single device. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code of the App.
2. User Conduct: You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not:

• use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party’s use and enjoyment of the App;
• attempt to gain unauthorized access to the App or its related systems or networks;
• upload, post, transmit, or otherwise make available any content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

3. User Content: You may submit, upload, publish, or otherwise make available content through the App. You grant Aureolls a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such content in all formats and distribution channels now known or hereafter devised (including in connection with the App and Aureolls’s business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
4. Disclaimer of Warranties: The App is provided on an “as is” and “as available” basis. Aureolls makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included in the App. You expressly agree that your use of the App is at your sole risk.
5. Limitation of Liability: Aureolls shall not be liable for any damages of any kind arising from the use of the App, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
6. Changes to Terms: Aureolls reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect.
